Enforcing PIPEDA against foreign organizations

The Federal Court recently ordered Romanian-based Globe24h to change its practices to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) in A.T. v. Globe24h.com. This has been repeatedly described as a “landmark” decision because it is the first to result in an order against a foreign organization under PIPEDA.

While A.T. v. Globe24h.com is notable, this issue of PrivacyScan questions whether its significance has been overstated, and, more importantly, explains why this case has little if anything to do with a “right to be forgotten”.
