CASL review Part 2: Enforcement

This is the second in a series of articles examining some of the key challenges under Canada’s Anti-Spam Legislation (CASL), written in anticipation of the pending Parliamentary review of the legislation. While the first article looked at the application of CASL to non-commercial transactional and relationship messages, this article considers the enforcement regime under CASL, and recommends that it be revised to be more proportional to the nature of the issues that the legislation is intended to address.
